Terms of Service

1. Company and Credentials

Fast Track Radon Testing, LLC is a Florida-certified radon measurement business, certification RB3086. Professional measurement review is performed under the supervision of a Florida-certified Radon Measurement Specialist. Current credentials will be displayed in the final customer report as required.

2. Scope of Services

Fast Track provides radon measurement and reporting services. Unless separately stated in writing, we do not provide radon mitigation, repairs, construction, engineering, environmental remediation, real-estate appraisal, legal advice, medical advice, or a guarantee that a property is free of radon.

Radon levels can change with weather, season, ventilation, occupancy, building operation, and other conditions. A report describes the conditions and results of the specific test period and locations identified in the report. It is not a guarantee of past or future radon levels elsewhere in the property.

3. Service Configuration and Pricing

The standard residential service includes two time-sensitive test devices at one test location for a property up to 2,000 square feet. Additional devices required because of property size or configuration are $100 each. Properties larger than 2,000 square feet require at least one additional device, and additional devices may be recommended for separate foundations, HVAC zones, attached or detached areas, mixed-use spaces, or other conditions affecting representative placement.

The website questionnaire provides an initial device recommendation and price. Fast Track may revise the recommendation before deployment if the information supplied is incomplete or if site conditions differ materially from the booking information. We will disclose and obtain approval for any added charge before proceeding.

4. Customer Responsibilities

The customer agrees to:

• Provide accurate property, contact, access, and transaction information.
• Have authority to authorize testing and allow access to the property.
• Ensure safe and timely access for placement and retrieval.
• Follow all written and verbal test-condition instructions.
• Maintain required closed-building conditions before and during short-term testing.
• Operate heating and cooling systems normally, without using equipment that brings outside air into the test area unless required for normal building operation or safety.
• Avoid moving, covering, opening, tampering with, or otherwise disturbing any test device.
• Inform occupants, agents, contractors, and visitors that testing is in progress.
• Disclose unusual events that may affect the test, including open windows or exterior doors, construction, severe weather, HVAC changes, power outages, or device disturbance.

Fast Track may document apparent interference or invalid test conditions and may recommend or require a retest.

5. Scheduling and Access

Appointment windows are estimates and may change because of traffic, weather, safety conditions, laboratory operations, access issues, or circumstances outside our reasonable control. If we cannot safely access the property, the appointment may be rescheduled. The Cancellation and Refund Policy posted on this website is incorporated into these Terms.

6. Testing, Laboratory Analysis, and Quality Control

Fast Track uses approved measurement methods and a qualified laboratory. Laboratory turnaround times are estimates and may be affected by shipping, laboratory operations, holidays, or sample issues.

All reports are subject to data review, quality-control checks, Measurement Specialist sign-off, owner approval, and payment verification. Fast Track may correct a draft or previously delivered report if a clerical, calculation, laboratory, or compliance issue is identified. Any corrected report will replace the earlier version.

7. Results and Recommendations

Results are reported in picocuries per liter (pCi/L). When simultaneous devices are used at the same measurement location, Fast Track will calculate and report the result according to its approved procedures and applicable requirements. The report will include the required Florida notice and applicable business, professional, and laboratory credentials.

The customer is responsible for deciding whether to conduct follow-up testing, consult a certified mitigation professional, or take other action. Fast Track does not guarantee a real-estate closing, appraisal result, insurance decision, regulatory outcome, or mitigation result.

8. Payment and Report Release

Prices and applicable charges are shown during booking or provided in a written quote. Payment is due according to the booking confirmation or invoice. The final report will not be released until required quality-control and approval steps are complete and the balance is paid, except when otherwise required by law or agreed in writing.

You authorize Fast Track and its payment processor to charge the payment method you provide for approved services and charges. You are responsible for any chargeback or returned-payment costs allowed by law when a valid charge is improperly reversed.

9. Cancellation, Retesting, and Refunds

The separate Cancellation and Refund Policy posted on this website controls cancellations, rescheduling, invalid tests, retesting, and refunds and is incorporated into these Terms.

10. Communications and Electronic Records

You consent to receive service-related communications by email, telephone, text message, or website notification using the contact information you provide. Electronic agreements, approvals, invoices, notices, and reports satisfy any requirement that the communication be in writing, to the extent permitted by law. Marketing messages, if any, will be handled separately and may be declined.

11. Authorized Report Recipients

Fast Track will deliver reports only to the customer and other recipients identified or authorized by the customer, except where disclosure is required by law. The customer is responsible for providing accurate recipient information and for any onward distribution of a report after delivery.

12. Website Use

You may use the website only for lawful purposes. You may not interfere with the website, attempt unauthorized access, introduce malicious code, submit false information, misuse another person's information, or copy or exploit website content in violation of applicable law.

13. Intellectual Property and Report Use

The website content, forms, templates, branding, and original materials belong to Fast Track or its licensors. A customer who has paid for a report may use and share that report for the tested property and transaction. The report may not be altered in a way that misrepresents its results, scope, date, credentials, or conclusions.

14. Disclaimer and Limitation of Liability

Fast Track will perform services with reasonable care consistent with applicable requirements and approved procedures. Except for obligations that cannot legally be limited, services and the website are provided without any additional express or implied warranty.

To the maximum extent permitted by Florida law, Fast Track will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits, lost transactions, delay costs, diminution in property value, or decisions made by third parties. Fast Track's total liability arising from a service will not exceed the amount the customer paid Fast Track for that service. These limitations do not apply to liability that cannot be limited by law.

15. Indemnification

To the extent permitted by law, you agree to be responsible for claims, costs, or losses arising from materially false information you provide, your lack of authority to order testing, unsafe access conditions you control, device interference by you or persons under your direction, or unlawful misuse or alteration of a report.

16. Governing Law and Disputes

These Terms are governed by Florida law, without regard to conflict-of-law rules. Before filing a claim, each party agrees to give the other written notice and a reasonable opportunity to resolve the dispute informally. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court with jurisdiction in Broward County, Florida.

17. Changes and Severability

We may update these Terms prospectively by posting a revised version with a new effective date. The Terms in effect when a service is booked will govern that service unless a later change is required by law. If any provision is found unenforceable, the remaining provisions will remain in effect.
